These Terms of Use (“Terms”) govern your access to and use of the Wearly mobile application, website, and related services (“Wearly,” “the app,” “we,” “our,” or “us”).

By downloading, accessing, or using Wearly, you agree to these Terms. If you do not agree to these Terms, do not use the app.

## 1. Description of Service

Wearly is a weather-based outfit recommendation and virtual styling app.

Wearly may provide features such as:

- Weather-based outfit recommendations

- AI-powered styling suggestions

- Optional closet-based personalization

- Optional virtual try-on previews

- Saved outfits, favorites, and history

- Premium features through auto-renewable subscriptions

Wearly is intended to provide styling assistance and outfit inspiration. Recommendations are generated automatically and may not always be accurate, suitable, available, weather-appropriate, or appropriate for every personal preference or situation.

## 2. Eligibility

You must be at least 13 years old to use Wearly.

By using Wearly, you confirm that you are legally able to enter into these Terms.

## 3. Account Registration

Some features may require an account.

You agree to provide accurate information and to keep your login credentials secure.

You are responsible for all activity that occurs under your account.

If you believe your account has been accessed without authorization, contact us at hello@wearly.com.

## 4. User Content

Wearly may allow you to upload, create, save, or submit content, including photos, outfit preferences, closet items, and generated try-on results (“User Content”).

You retain ownership of your User Content.

By using Wearly, you grant us a limited, non-exclusive, worldwide license to process, display, transmit, and store your User Content only as necessary to operate and provide the app’s features.

For example, if you use the virtual try-on feature, you allow Wearly to process your uploaded photo to generate a try-on preview.

You represent and warrant that:

- You own or have the necessary rights to the content you upload

- Your content does not violate the rights of others

- Your content does not violate any applicable law

- Your content does not contain illegal, harmful, abusive, or exploitative material

## 5. Photos, Try-On, and AI-Generated Results

The virtual try-on feature is optional.

Try-on results are generated using automated image-processing technology and may be inaccurate, incomplete, unrealistic, or visually imperfect.

Wearly does not guarantee that generated results will match real clothing fit, size, color, texture, availability, or appearance.

You should not rely on Wearly as the sole basis for purchase, safety, health, weather protection, or event-specific clothing decisions.

You are responsible for reviewing any generated output before using, saving, or sharing it.

## 6. Subscriptions and Premium Features

Wearly may offer premium features through auto-renewable subscriptions.

Available subscription options may include:

- Wearly Premium Monthly

- Wearly Premium Yearly

The exact subscription title, duration, price, trial availability, and included features are displayed in the app before purchase.

Payment will be charged to your Apple ID account at confirmation of purchase.

Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.

Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current billing period.

You can manage or cancel your subscription in your Apple ID account settings.

If a free trial or introductory offer is available, it will be shown before purchase. Any unused portion of a free trial may be forfeited when you purchase a subscription, where applicable.

Premium access is managed through Apple’s In-App Purchase system and RevenueCat.

## 7. Subscription Cancellation

You can cancel your subscription through your Apple ID settings.

Deleting the app does not cancel your subscription.

If you cancel, you may continue to access premium features until the end of the current paid subscription period.

We cannot directly cancel subscriptions purchased through Apple on your behalf.

## 8. Refunds

Purchases made through Apple are handled by Apple.

Refund requests are subject to Apple’s refund policies and must be submitted to Apple.

Wearly does not control Apple’s refund decisions.

## 9. Terms of Use / EULA

These Terms apply to your use of Wearly.

For apps downloaded from the Apple App Store, these Terms are in addition to Apple’s applicable terms and conditions, including the Apple Media Services Terms and Conditions and, where applicable, Apple’s standard End User License Agreement.

If there is a conflict between these Terms and Apple’s applicable terms for App Store purchases, Apple’s terms may apply to the extent required by Apple.

## 10. Privacy

Your use of Wearly is also governed by our Privacy Policy.

The Privacy Policy explains how we collect, use, share, store, and protect information, including location data, photos, and face-related data that may be included in optional try-on photos.

Please review the Privacy Policy before using Wearly.

## 11. Acceptable Use

You agree not to:

- Use Wearly for illegal, harmful, abusive, or fraudulent purposes

- Upload content that violates another person’s rights

- Upload explicit, exploitative, hateful, or harmful content

- Attempt to reverse engineer, copy, modify, or interfere with the app

- Attempt to bypass subscription restrictions or premium access controls

- Use automated systems to abuse, overload, or disrupt the service

- Use Wearly to create misleading, harmful, or unlawful content

- Violate applicable laws or regulations

We may suspend or terminate access if we believe you have violated these Terms.

## 12. Intellectual Property

Wearly, including its design, branding, software, features, text, graphics, logos, and other materials, is owned by us or our licensors and is protected by intellectual property laws.

You may not copy, distribute, modify, sell, lease, or create derivative works based on Wearly unless we give you written permission.

## 13. Third-Party Services

Wearly may rely on third-party services, including authentication providers, weather data providers, subscription management tools, cloud infrastructure, and AI image-processing providers.

We are not responsible for third-party services, their availability, or their independent terms and policies.

## 14. Service Availability

We try to keep Wearly available and functioning, but we do not guarantee uninterrupted, error-free, secure, or always available service.

Features may change, be limited, or be discontinued at any time.

We may update the app to improve functionality, security, or compliance.

## 15. Disclaimers

Wearly is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.

Wearly’s outfit recommendations, weather-based suggestions, and try-on previews are for informational and entertainment purposes only.

We do not guarantee that recommendations will be accurate, suitable, fashionable, weather-safe, or appropriate for any specific event, condition, or user.

## 16. Limitation of Liability

To the fullest extent permitted by law, Wearly and its developers, owners, partners, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, loss of goodwill, service interruptions, inaccurate recommendations, or issues arising from use of AI-generated results.

Our total liability for any claim related to Wearly will be limited to the amount you paid to use Wearly during the three months before the claim, or the minimum amount permitted by applicable law.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

## 17. Termination

We may suspend or terminate your access to Wearly if:

- You violate these Terms

- Your use creates risk or legal exposure

- We are required to do so by law

- We discontinue the app or relevant features

You may stop using Wearly at any time.

Termination does not automatically cancel an active Apple subscription. You must cancel subscriptions through your Apple ID settings.

## 18. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we will update the “Last Updated” date and may provide additional notice where required.

Your continued use of Wearly after changes become effective means you accept the updated Terms.

## 19. Governing Law

These Terms are governed by applicable laws, without regard to conflict of law principles, except where consumer protection laws in your country require otherwise.
